EAAGuard Terms of Service

1. What EAAGuard is
EAAGuard is an automated accessibility scanning service that helps you identify potential WCAG 2.1 / 2.2 issues on your website and supports your work toward European Accessibility Act readiness. EAAGuard also operates a marketplace that connects you with independent third-party auditors for manual review.
EAAGuard does not:
- Guarantee that your website is compliant with the European Accessibility Act, EN 301 549, WCAG, or any other regulation.
- Certify your site as compliant or fit for any specific purpose.
- Protect you from regulatory fines, audits, or legal action.
- Replace a qualified human accessibility auditor.
Automated scanning typically detects approximately 30-40% of WCAG issues. Full compliance requires manual testing by qualified auditors. The information EAAGuard produces is advisory.
2. Your account
You must provide accurate registration information and keep your credentials confidential. You are responsible for any activity on your account. You must be at least 18 years old to create a paying account.
3. Acceptable use
You may scan only websites you own or have explicit permission to scan. You may not use EAAGuard to:
- Scan sites where you lack authorisation.
- Probe rate limits, attempt to bypass authentication, or otherwise stress-test third-party infrastructure.
- Resell raw scan output as a stand-alone compliance certificate.
- Use the marketplace to circumvent the platform (off-platform payments, off-platform contracting after EAAGuard introduces you to an auditor).
4. Service availability
EAAGuard is provided as is, on a best-effort basis. Scans may be delayed, paused, or cancelled when the worker capacity is exhausted, when a target site rate-limits us, or when we suspect abuse.
5. Subscription, billing and Paddle
Key billing terms:
- All payments are processed by Paddle, which acts as our Merchant of Record. Paddle handles billing and invoicing on your behalf.
- EAAGuard does not store your credit card numbers or full payment details.
- Paid plans are billed on a recurring basis (monthly by default) and renew automatically until cancelled.
- Prices are listed in the currency shown on the checkout page. Taxes (where applicable) are determined at checkout based on your billing location.
- You may cancel your subscription at any time from your Billing page. Cancellation takes effect at the end of the current billing period; you retain access until then.
- All limits (sites, pages per scan, scans per month) are hard limits. When you downgrade, you choose which sites stay active within the new limit; the rest are paused, not deleted.
- Refunds are handled in accordance with our Refund Policy.
6. Marketplace
The marketplace is governed by separate Marketplace Terms. In short:
- Marketplace auditors are independent contractors. They are not employees, agents, partners, or sub-contractors of EAAGuard.
- EAAGuard verifies credentials presented by auditors but does not certify, endorse, or warrant their work product.
- The platform takes a 20% fee on the quoted price; the rest is remitted to the auditor.
- Ratings and reviews on auditors are published from real clients. EAAGuard may remove unlawful or abusive content but does not edit ratings.
7. Disclaimer of warranties
To the maximum extent permitted by law, EAAGuard disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Recommendations in scan reports, dashboards and accessibility statements are advisory only. Responsibility for accessibility compliance, regulatory filings, and the legal sufficiency of any document remains with you.
8. Limitation of liability
To the maximum extent permitted by law:
- EAAGuard's total liability arising out of or related to the service is capped at the fees you paid in the twelve (12) months preceding the claim.
- EAAGuard is not liable for indirect, incidental, consequential, special or punitive damages, including lost profits, lost data, regulatory fines, or reputational harm.
- These limits apply even if EAAGuard has been advised of the possibility of such damages.
Mandatory consumer-protection laws in your jurisdiction may override these limits.
9. Your warranties and indemnity
You warrant that you have the right to scan the URLs you submit, that the data you provide is accurate, and that you will use EAAGuard in compliance with applicable law. You will indemnify and hold EAAGuard harmless from third-party claims arising out of your use of the service or your scanned websites.
10. Suspension and termination
We may suspend or terminate your account for breach of these Terms, for abuse of the platform, or as required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period.
11. Changes
We may update these Terms. Material changes are notified by email at least 14 days before they take effect. Continued use of EAAGuard after the effective date means you accept the new Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which EAAGuard is established. Mandatory consumer-protection laws of your residence apply where required.
