Spain transposed the EAA via Real Decreto-ley 6/2023 of 19 December 2023. Enforcement is led by the Direccion General de Politicas de Discapacidad.
What it is
Real Decreto-ley 6/2023 of 19 December 2023 transposed the EAA into Spanish law. The substantive rules apply from 28 June 2025, with the standard EU transition period to 28 June 2030 for existing service contracts and self-service terminals.
Spain also runs Real Decreto 1112/2018 for public-sector accessibility (public administration websites and mobile apps); the two regimes coexist and share methodology (WCAG 2.1 AA via UNE-EN 301549).
Who it applies to
Covered: manufacturers, importers, distributors and service providers active on the Spanish market. Microenterprises providing services are exempt from substantive obligations.
Examples in scope: consumer banking, e-commerce, e-books and e-readers, passenger-transport websites and apps, self-service ticketing kiosks, ATMs, electronic communication services.
Penalties and enforcement
The Spanish regime classifies infringements as leves, graves or muy graves (minor, serious, very serious) with the most severe band carrying fines up to EUR 1 million under the consolidated consumer-protection framework. Repeated or willful violations can also trigger commercial restrictions and publication of the sanction.
Standards
UNE-EN 301549 (the Spanish adoption of EN 301 549) gives the presumption of conformity. It references WCAG 2.1 Level AA for web content.
